Member Boat Storage Policy

By a member ("Member") of Edinburgh Kayak Club (the "Club") making an initial payment to store a boat(s) in the EKC boat shed, the Club and the Member agree to be bound, in full, by the following terms and conditions:

  1. Only kayaks/OC1 under 10 foot (3.04 metres) length are permitted to be stored. (strictly no boats over this length, the Club doesn't have space for sea boats, or Canadians).

  2. Boats should be primarily and actively used by the member.

  3. Member boats shall be stored in the back section of the EKC Boat Shed which is accessed by the back door.

  4. The Member shall pay £72 per year per boat (£6/month), payable yearly in advance (the "Storage Fee"). The Club shall be entitled to review and amend the level of the Storage Fee from time to time, subject to providing the Member 1 months notice of the amended figure in advance of the new membership year.

  5. Payment of the Storage Fee shall be made in full on 1 April each year, being the start of the membership year. In the event that storage is commenced later than the start of the membership year the Storage Fee shall be prorated on the basis of the months remaining in the membership year (part months shall be charged at the monthly rate).

  6. The Club reserves the right to cease allowing the storage of personal boats in the shed, or adjust the level of this provision, from any or all members at any time, subject to giving 2 months notice in advance. In these circumstances a prorated refund shall be made by the Club to each affected Member for complete unused months.

  7. The Member can opt to cease storing their boat at the Shed at any time, subject to giving the Club 1 months notice in advance. In these circumstances a prorated refund shall be made by the Club to the Member in respect of all remaining complete unused months in the Membership Year.

  8. The Club shall be entitled to lock or remove the boat should the Member fail to pay the annual Storage Fee within one month of the start of the membership year. Provided the Storage Fee is paid by the Member within 3 months of the start of the membership year the boat shall be returned by the Club to the Member.

  9. Any attempt by the Member to unlock a boat that has been locked for non payment of the Storage Fee shall be reported to the Club Committee and may result in termination of membership.

  10. The boat shall be deemed to be permanently gifted by the Member to the Club, with ownership transferred, in the event that the Member fails to pay the annual Storage Fee within 3 months of the start of the membership year.

  11. The Club shall lend to the Member only a key for the back door of the shed, upon payment by the Member of the Storage Fee and Deposit.

  12. A £100 deposit will be taken for issuing keys (the "Deposit"). This deposit will be returned in full minus any costs incurred due to the loss of or failure to return keys.

  13. Loss of keys will just be charged at cost.

  14. Failure to return a key once no longer a fully paid up storage member may result in changing the locks - in which case it is likely that the whole deposit will be forfeit.

  15. This facility is only available to members of the Club. Lapsed members will be treated as late payers. If a lapsed Member fails to renew their membership of the Club then they must within 3 months of the start of the membership year and prior to removing their boat, pay any outstanding Storage Fee prorated to cover the months of the membership year that the boat has been stored. In the event that the lapsed Member has not paid the outstanding Storage Fee and removed the boat within 3 months of the start of the membership year then the boat shall be deemed to be permanently gifted, with ownership transferred, by the lapsed Member to the Club.

  16. The Member shall only be permitted to store boats and their permanently fixed accessories within the shed. The Member is not permitted to store in the shed any soft kit or paddles within or outwith the boat. For the avoidance of doubt the storage by the Member of anything flammable within the shed is strictly prohibited and the Club reserves it rights to sue the Member in the event that a flammable item is stored and results or contributes to the destruction of the shed, or any part thereof.

  17. The Member shall ensure that the boat is clearly labelled with their name & contact details.

  18. The Member shall ensure that the boat is fully drained prior to storage.

  19. The Member shall ensure that the boats is stored in a safe, secure manner within the shed. The Club shall provide ropes and suitable fixtures to facilitate this.

  20. The Club's Boat Storage Officer must be notified if the Member changes the boat they are storing in the shed to a different boat.

  21. The Members may choose, but is not obliged, to padlock their boat to the racking using their own lock. In the event the Member opts to lock their boat they must provide the Club's Boat Storage Officer with an additional key for the lock, so that the boat can be moved by the Club if required.

  22. In the event of oversubscription at the start of the membership year, by members of the Club seeking to store their personal boats in the shed, then each Member who paid a Storage Fee for a boat or boats in the previous membership year will be given priority to continue to store up to one boat. In the event a Member stored more than one boat in the previous membership year in the shed and there is no longer capacity for these boats due to oversubscription then the Club shall give the Member 1 months notice to remove these boats and a prorated refund of the Storage Fee, for the new membership year, shall be made by the Club to the Member for complete unused months. In the event of oversubscription a waiting list will be maintained by the Club.

  23. The Boat Storage Officer will fairly determine the allocation of boat storage spaces in the event of oversubscription. Appeals may be submitted to the committee in writing.

  24. The Club shall provide no insurance to the Member against any loss or damage to the boat during storage. Members are recommended to provide their own insurance. (SCA insurance is based on the membership year. Monthly insurance is available from, amongst others, E&L. This is not a recommendation of the suitability of any policy)

  25. The Club accepts no liability for loss, theft or damage for boats stored by the Member in the shed.

  26. Access to the rear storage area, from the main shed, will be retained by the Club.

  27. Any boat stored by a Member must not be used by the Club or other storage members, except with the express permission of the Member.

  28. The Club will store contact, boat & payment details for each member using the facility to ensure we are able to fulfil our contractual obligations.
